These Terms govern access to and use of pelmarilearning.com. They address the website as a whole. A purchase or enrollment is also governed by the applicable offering description, order confirmation, and Terms of Service.

Acceptance of these Terms

By accessing or using this website, a visitor agrees to these Terms & Conditions and the policies incorporated by reference. A person who does not agree should not use the website. If a person uses the website for an organization, that person represents that they are authorized to accept these Terms for the organization.

These Terms apply to browsing, account use, checkout, access to public resources, and other website functions. Terms that are specific to a course, workshop, session, package, or guided program control if they directly conflict with a general provision here.

Eligibility and authority

A person must be legally capable of entering a binding agreement to make a purchase. A minor may use an offering only with the involvement and authorization of a parent or legal guardian where required. Some offerings may specify a minimum age, prerequisite, technology requirement, location limitation, or other eligibility condition.

The purchaser is responsible for providing accurate information and for ensuring that the selected offering is appropriate for the intended learner. Pelmari Learning may decline or cancel an order when information is materially inaccurate, payment is unauthorized, participation would create a safety or legal concern, or the requested service is unavailable.

Website information

Pelmari Learning aims to describe offerings, prices, formats, and included materials clearly. Website content is general information and may not include every term relevant to a particular order. Availability, instructor scheduling, start dates, access periods, prerequisites, and materials should be confirmed in the applicable program description or written scope.

Reasonable efforts may be made to correct typographical, pricing, or technical errors. If a material error affects an order, the purchaser will be given an appropriate correction, option to confirm the corrected order, or cancellation and refund as required.

Accounts and credentials

If an account is required, the account holder must provide accurate information, maintain the confidentiality of credentials, and promptly report suspected unauthorized use. One learner may not share access with another person unless the applicable offering expressly permits shared or group access.

The account holder is responsible for activity performed through the account to the extent permitted by law. Pelmari Learning may require a password reset, identity check, or other reasonable security step before restoring access or responding to a sensitive request.

Acceptable use

A visitor or learner may not use the website to violate law, infringe intellectual property, impersonate another person, collect information without authorization, distribute malware, test system vulnerabilities without written permission, interfere with platform operation, bypass access controls, automate extraction of substantial content, or use content to build a competing course or resource library.

A person also may not harass instructors or participants, record a private session without all required permissions, submit unlawful or misleading material, or use a discussion feature in a way that disrupts the learning environment. Reasonable participation rules may be applied to live or group activities.

Intellectual property

The website design, written content, course structure, graphics, videos, audio, downloadable resources, templates, exercises, and other original materials are owned by Pelmari Learning or used under permission, except where another owner is identified. Access does not transfer ownership.

A purchaser receives only the limited personal-use rights stated in the Digital Products & Course Access Policy and the applicable offering terms. No material may be reproduced, republished, sold, sublicensed, distributed, publicly performed, uploaded to a shared repository, or used to train a commercial system except with prior written permission or as allowed by law.

Third-party services

The website or an offering may depend on third-party e-commerce, payment, course-hosting, video-conferencing, file-delivery, or communication services. Those services may have separate terms and privacy notices. Pelmari Learning does not control every third-party feature, maintenance period, or policy.

A reference to an external resource does not necessarily constitute an endorsement. The visitor is responsible for evaluating external content and for using third-party services in accordance with their applicable rules.

Educational nature and no guarantee

Website content and services are educational. They do not guarantee mastery, employment, promotion, income, admission, licensing, certification, academic credit, continuing-education credit, or any specific result. Outcomes depend on the learner's circumstances, participation, prior knowledge, practice, and independent decisions.

Unless a program description expressly states otherwise, Pelmari Learning is not an accredited educational institution and an offering should not be treated as a degree, professional license, regulated credential, or substitute for advice from a qualified professional.

Disclaimers

To the extent permitted by law, the website is provided on an “as available” basis. Pelmari Learning does not warrant uninterrupted access, error-free operation, compatibility with every device, or that every piece of information will remain current. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.

Maintenance, platform outages, security events, network conditions, and circumstances outside reasonable control may affect access. The applicable policies explain available remedies for purchased access.

Limitation of liability

To the extent permitted by law, Pelmari Learning will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from website use, loss of access, reliance on general educational information, or third-party services. This limitation does not apply where liability cannot legally be limited.

For a claim directly related to a purchase, aggregate liability will not exceed the amount paid for the specific offering giving rise to the claim, unless applicable law requires a greater remedy. A person remains responsible for backing up their own work and using reasonable security practices.

Indemnification

To the extent permitted by law, a person using the website on behalf of a business agrees to defend and indemnify Pelmari Learning from third-party claims arising from that person's unlawful use, infringement, unauthorized content, or material breach of these Terms. This provision does not require indemnification for Pelmari Learning's own conduct where prohibited by law.

Changes, suspension, and termination

Pelmari Learning may modify or discontinue a website feature, suspend access that presents a security or legal risk, or terminate use for a material breach. When purchased access is affected, the Terms of Service and applicable refund policy determine the available remedy.

These Terms may be revised as the website or law changes. The updated version applies from the stated effective date. Material changes affecting an existing paid service will not retroactively remove rights already earned unless the law permits and appropriate notice is given.

Governing law and disputes

These Terms are governed by the laws of the State of Colorado and applicable United States federal law, without regard to conflict-of-law principles. Before filing a claim, the parties are encouraged to provide written notice describing the issue and allow a reasonable opportunity for direct resolution.

Any court proceeding shall be brought in a court with jurisdiction over Fort Collins, Colorado, unless a mandatory consumer-protection rule requires another location. Nothing here prevents either party from seeking urgent relief for misuse of intellectual property, unauthorized access, or an immediate security concern.

General provisions

If a provision is found unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver. Rights may not be assigned by a user without written consent; Pelmari Learning may assign these Terms as part of a lawful business transfer. Headings are for convenience and do not change meaning.
